1. General
This Privacy Policy explains how Ballr Pty Ltd (ACN 686 584 725, ABN 25 686 584 725) (Ballr, we, us or our) collects, holds, uses and discloses Personal Information.
Ballr owns and operates the shared Ballr ecosystem, including BallrBet, our wagering product available at ballrbet.com, and Ballr, our sports, fantasy, content, community and engagement product available at ballr.live (together, the Platforms). Ballr Pty Ltd trades as BallrBet in relation to the wagering website and associated wagering services.
In this Privacy Policy, Personal Information has the meaning given to that term in the Privacy Act 1988 (Cth), being information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether recorded in a material form or not.
Ballr is committed to collecting, using, disclosing and protecting Personal Information in accordance with the Privacy Act, the Australian Privacy Principles and all applicable wagering, anti-money laundering and counter-terrorism financing, responsible gambling, spam, direct marketing and other legal and regulatory obligations.
By using either Platform, opening a BallrBet account, creating a Ballr account, participating in Ballr products or services, or otherwise providing Personal Information to us, you acknowledge that we will handle your Personal Information in accordance with this Privacy Policy and any collection notice provided at the time of collection. By opening a BallrBet account, you also agree to be bound by the BallrBet Terms and Conditions in conjunction with this Privacy Policy.
2. Platforms and people covered by this Privacy Policy
This Privacy Policy applies to Personal Information collected through or in connection with:
- BallrBet, including ballrbet.com, any BallrBet mobile website, app or account area, and any wagering-related customer service, compliance, verification, payments, promotions and responsible gambling activity;
- Ballr, including ballr.live, fantasy tools, content, competitions, community features, newsletters, social and digital campaigns, and other non-wagering sports engagement products;
- our marketing, advertising, analytics, customer support, compliance, payment, identity verification, security and operational systems; and
- our relationships with customers, prospective customers, suppliers, service providers, partners, employees, job applicants, contractors and business contacts.
BallrBet and Ballr accounts are not currently linked into a single customer login. However, we may collect and use information across the Platforms to understand how users interact with the Ballr ecosystem, improve our services, personalise experiences, measure advertising effectiveness, protect customers, meet legal obligations and manage risk, as described in this Privacy Policy.
3. Personal Information we collect
The types of Personal Information we may collect depend on your relationship with us and which Platform you use. This may include:
- identification and account information, including name, username, date of birth, residential address, email address, phone number, gender, account credentials and customer numbers;
- identity verification information, including identification document information, photographs or images, verification results and information checked against government, third-party or independent databases;
- wagering and BallrBet information, including account status, deposits, withdrawals, payment instruments, betting activity, transaction history, bonuses, preferences, responsible gambling settings, limits, self-exclusion status and customer support interactions;
- Ballr and ballr.live information, including fantasy tool usage, competition entries, content views, preferences, teams, leagues, community participation and engagement activity;
- technical and usage information, including IP address, device information, browser type, operating system, device identifiers, advertising identifiers, cookie identifiers, log-in activity, pages viewed, links clicked, referral source, session data and approximate location derived from IP or device data;
- communications information, including email, SMS, push notification, phone, live chat, social media, website and app communications, and recordings or records of telephone calls and digital activity;
- marketing and consent information, including marketing preferences, consents, opt-outs, campaign engagement, conversion events, attribution data and suppression list status;
- fraud, security, compliance and risk information, including suspicious activity indicators, duplicate account indicators, payment risk information, AML/CTF information, source of funds information where required, responsible gambling indicators and information needed to comply with BetStop or other exclusion obligations;
- employment, contractor, supplier and business contact information where relevant to our business operations.
You must only provide accurate information that you are authorised to disclose, so that we can use your Personal Information in accordance with this Privacy Policy.
4. How we collect Personal Information
We usually collect Personal Information directly from you when you register, open an account, use the Platforms, enter a competition, place a bet, contact us, update your details, use our fantasy tools, interact with our content, respond to marketing, apply for employment or otherwise provide information to us.
We may also collect Personal Information automatically when you use the Platforms, including through cookies, pixels, tags, software development kits, device identifiers, analytics tools, advertising technologies and server logs.
We may collect Personal Information from third parties where lawful and appropriate, including identity verification providers, payment providers, wagering platform providers, fraud prevention providers, analytics and advertising platforms, data hosting and technology providers, regulators, racing and sports controlling bodies, law enforcement agencies, BetStop and other exclusion registers, affiliates, partners and service providers.
When we collect Personal Information, we will take reasonable steps to ensure that you are aware of relevant information about the collection, use, disclosure and handling of that information. We may do this through this Privacy Policy, a Privacy Collection Statement, account registration terms, platform notices or other collection notices provided at or before the time of collection.
5. Dealing with Ballr anonymously or using a pseudonym
Where appropriate, we will allow you to deal with us anonymously or using a pseudonym. However, if you do not provide Personal Information we request, we may be unable to process an application to open a BallrBet account, verify your identity or age, provide wagering services, process payments or withdrawals, provide the full range of Ballr services, respond to enquiries, consider a job application, or enter into arrangements with you or your organisation.
6. Cross-site tracking across ballrbet.com and ballr.live
We may use cookies, pixels, tags, device identifiers, IP addresses, browser information, advertising identifiers and analytics tools to understand how users interact with ballrbet.com and ballr.live. This may occur even though BallrBet and Ballr accounts are not currently linked into a single login.
We may use cross-site tracking and analytics to:
- measure traffic, engagement, content performance and conversion across the Ballr ecosystem;
- understand whether users move between ballr.live and ballrbet.com;
- measure the effectiveness of banners, onsite advertising, paid media, search, social advertising and referral campaigns;
- personalise onsite experiences, content, fantasy tools, messages and recommendations;
- show relevant onsite banners and advertising, including BallrBet banners on ballr.live where legally permitted;
- create audiences, lookalike audiences, suppression lists, retargeting lists and campaign reports where permitted by law and platform rules;
- prevent fraud, detect duplicate or suspicious activity, protect account security and maintain platform integrity;
- support responsible gambling, self-exclusion, BetStop, marketing suppression and other compliance controls.
The advertising and analytics tools we may use include Google Analytics, Google Ads, Meta Pixel and TikTok Pixel. These providers may collect or receive information from our Platforms and elsewhere on the internet and use that information to provide measurement services, advertising services, reporting and other services to us. Their handling of information is also governed by their own terms and privacy policies.
You can control cookies and similar technologies through your browser or device settings. If you disable cookies or tracking technologies, some Platform features may not function as intended and we may be less able to personalise your experience or measure our services.
7. Why we use Personal Information
We may use Personal Information for the purposes for which it was collected, purposes notified at the time of collection, related purposes you would reasonably expect, purposes you have consented to, and purposes otherwise required or permitted by law. These purposes include:
- processing applications, registrations and account openings;
- operating, maintaining, administering and improving BallrBet and Ballr;
- providing wagering services, fantasy tools, content, competitions, customer support, account management and communications;
- identifying customers, verifying age and identity, conducting KYC, AML/CTF, fraud, security and payment checks, and complying with regulatory obligations;
- processing deposits, withdrawals, refunds, payments, chargebacks and account adjustments;
- determining liability for goods and services tax, point of consumption tax and other taxes, levies, fees or charges where applicable;
- personalising content, fantasy tools, betting offers where legally permitted, emails, SMS, push notifications and onsite experiences;
- conducting analytics, research, segmentation, profiling, statistical analysis, product development and performance measurement;
- creating aggregate or de-identified data through demographic profiling, behavioural analysis and statistical analysis to help operate and improve the Ballr business, and to share insights with potential and existing stakeholders where individuals are not reasonably identifiable;
- delivering, measuring and improving advertising, including onsite advertising, paid media, conversion tracking, attribution and campaign reporting;
- sending administrative, service, account, security, responsible gambling, compliance and operational communications;
- sending marketing communications where permitted by law and consistent with your consent and preferences;
- maintaining suppression lists and ensuring people who have opted out, self-excluded or registered with BetStop do not receive direct wagering marketing;
- detecting, investigating and preventing fraud, unlawful activity, misconduct, misuse of promotions, duplicate accounts, bowler accounts, suspicious betting, payment risk, security incidents and integrity issues;
- meeting responsible gambling obligations and identifying potential gambling harm where relevant;
- protecting and maintaining the integrity of racing and sports by assisting regulators, racing bodies, sports controlling bodies, law enforcement and government agencies where required or appropriate;
- responding to enquiries, complaints, disputes, legal claims, regulator requests and enforcement activity;
- managing suppliers, contractors, employees, business partners and corporate transactions.
8. Marketing, advertising and consent
We may use Personal Information to market Ballr products and services where permitted by law. Every commercial electronic marketing message we send will include a functional unsubscribe or opt-out mechanism where required. We will action opt-out requests as soon as practicable and, where required by law, within the applicable timeframe. You may opt out of all marketing or a particular form of marketing by using the opt-out mechanism in the message or contacting us.
BallrBet is a wagering product and is subject to strict gambling advertising and direct marketing laws. We will not send direct BallrBet gambling marketing to Ballr or ballr.live users unless they have provided express and informed consent to receive gambling marketing and have not withdrawn that consent.
Before sending direct BallrBet gambling marketing, we may check or wash relevant marketing lists against BetStop, BallrBet self-exclusion records, other exclusion records, marketing suppression lists and consent records. We may use Personal Information collected through the Platforms for this compliance purpose.
Ballr.live may show public onsite banners, advertisements or brand promotions for BallrBet where legally permitted. These onsite banners are separate from direct marketing sent to an individual by email, SMS, push notification, phone or similar direct channels. Any BallrBet advertising displayed on ballr.live must comply with applicable gambling advertising laws and responsible gambling requirements.
If you opt out of marketing, we may still contact you for non-marketing purposes, including account administration, security, legal, regulatory, responsible gambling, compliance, service, payment, customer support and transactional communications.
9. No sale of Personal Information
Ballr does not sell, rent or trade customer Personal Information or customer data. We may disclose Personal Information to service providers, partners, regulators and other third parties as described in this Privacy Policy, but only for business, operational, compliance, legal, safety, security, analytics, advertising, service delivery or other lawful purposes. Where we provide de-identified or aggregated information, we will take reasonable steps so that individuals are not reasonably identifiable from that information.
10. Disclosure of Personal Information
We may disclose Personal Information, where appropriate and in accordance with legal and regulatory requirements, to:
- related bodies corporate, associated entities, affiliates and business partners involved in operating or supporting the Ballr ecosystem;
- wagering platform, managed trading, customer service, identity verification, document verification, KYC, AML/CTF, fraud prevention, payments, banking, chargeback, data hosting, IT, cyber security, analytics, advertising, marketing delivery, CRM, communications, customer support, consultancy, legal, accounting, audit and advisory service providers;
- Google Analytics, Google Ads, Meta Pixel, TikTok Pixel and similar analytics or advertising providers where those tools are used on the Platforms;
- regulators, government agencies, law enforcement agencies, courts, tribunals, racing bodies, sports controlling bodies, integrity bodies, AUSTRAC, VGCCC, ACMA, BetStop and other authorised bodies where required or permitted by law;
- principal racing authorities and sports controlling bodies for the purpose of protecting and maintaining the integrity of racing and sports, including by assisting with enquiries or notifying those bodies of unusual or suspicious betting activity where required or appropriate;
- law enforcement, government agencies and public health or safety bodies where we consider disclosure is necessary to eliminate or minimise a risk to public health or safety or where otherwise required or permitted by law;
- third parties involved in investigating, preventing or responding to fraud, unlawful activity, misconduct, suspicious activity, security incidents, disputes, chargebacks, integrity matters or responsible gambling concerns;
- professional advisers, insurers, investors, financiers, auditors and parties involved in a proposed or actual restructure, merger, acquisition, financing, sale or transfer of all or part of our business or assets;
- other third parties where you have consented, where you would reasonably expect the disclosure, where we have notified you, or where disclosure is otherwise required or permitted by law.
We take reasonable steps to ensure that third parties who handle Personal Information on our behalf protect it and use it only for the purpose for which it was provided, including through contractual obligations or other appropriate assurances where practicable.
11. Identity and document verification
You confirm that Personal Information you provide to us is true, accurate and complete and that you are authorised to disclose it. We may use third-party identity verification and document verification services to verify your identity, age, address, account details, payment details and other information required for BallrBet, AML/CTF, fraud prevention, security, responsible gambling, BetStop, exclusion and regulatory purposes. Verification may involve checking Personal Information against government, independent and third-party databases, identity documents, credit headers or other verification sources. We may disclose Personal Information to verification providers for these purposes.
12. Prohibited persons, BetStop and self-exclusion
Persons under the age of 18 are prohibited from opening a BallrBet account or using BallrBet wagering services. We will not knowingly accept Personal Information from minors for the purpose of opening a betting account.
If a person self-excludes from BallrBet, registers with BetStop, is barred or excluded, closes an account for responsible gambling reasons, or is otherwise prohibited from receiving wagering services or wagering marketing, we may record and use Personal Information about that person to comply with legal obligations, prevent account opening or betting, suppress marketing, close accounts, refund balances, conduct welfare checks where appropriate and protect customers.
We may use information collected across BallrBet and Ballr to help ensure that excluded, self-excluded, barred or prohibited persons do not receive direct BallrBet gambling marketing or open or use a BallrBet betting account.
13. Overseas disclosure and cloud storage
We may disclose Personal Information to overseas entities that provide support functions to us. We may also use cloud storage, IT systems, communications systems, analytics tools, advertising tools and service providers whose servers, personnel or related entities may be located outside Australia. You may contact us for more information about overseas disclosures.
14. Data security, account security and retention
We take reasonable steps to protect Personal Information from misuse, interference, loss, unauthorised access, unauthorised modification and unauthorised disclosure. These steps may include access controls, password protected systems, secure databases, Secure Socket Layer technology, staff, agent and contractor confidentiality obligations, vendor controls, monitoring, audit and security procedures.
You are responsible for the security of your access to the Platforms. You should log out of your account when you have completed your session and should not disclose your username, password, account details or other access credentials to any other person.
You acknowledge that no method of transmission over the internet or electronic storage is completely secure. Information you transmit to us is transmitted at your own risk.
We will destroy or permanently de-identify Personal Information when it is no longer required for any purpose permitted under the Privacy Act, the Australian Privacy Principles or other applicable laws, including legal, regulatory, AML/CTF, responsible gambling, BetStop, exclusion, accounting, audit, dispute, fraud prevention, security and operational obligations.
15. Accuracy, access and correction
We take reasonable steps to ensure that Personal Information we collect, use and disclose is accurate, complete, current and relevant having regard to the purpose for which it is used or disclosed. We may contact you periodically to seek the most current information from you.
You may request access to, or correction of, Personal Information we hold about you by contacting us. Where available, you may also access or update some account details through the Account or My Profile section of the relevant Platform. Details of BallrBet betting transactions may be available through the Account Transactions section of the BallrBet account area.
To protect privacy and security, we may require evidence to confirm your identity before providing access or making corrections. We will respond to requests within a reasonable timeframe, generally not exceeding 30 days. If your request is particularly complex or requires detailed searching of our records, there may be a cost to you for us to provide the information, where permitted by law.
We may refuse access or correction in circumstances permitted by law, including where giving access would be unlawful, would prejudice enforcement activities, would pose a serious threat to life, health or safety, would reveal commercially sensitive information, would be frivolous or vexatious, or where we are otherwise required or authorised to refuse. If we refuse a request, we will provide written reasons where required and information about available complaint mechanisms.
16. Third-party websites, social media and public areas
The Platforms may contain links to third-party websites, apps, social media platforms, advertising platforms or other services. This Privacy Policy does not apply to third-party services that we do not control. You should review the privacy policies and settings of those third-party services.
Information you post on bulletin boards, public forums, social media pages, community areas or other interactive features may become public. You should not post Personal Information you do not want to be public.
17. Changes to this Privacy Policy
We may review, change or update this Privacy Policy from time to time. The current version will be published on our Platforms. Changes take effect when published unless otherwise stated. Your continued use of the Platforms after publication means you acknowledge the updated Privacy Policy.
